Damien's Story

What the law says

The Gardaí can bring charges they believe are supported by evidence, but that doesn't mean every charge is necessary or proportionate. The Director of Public Prosecutions and the courts recognise that charges should be appropriate to the facts. Defence solicitors can challenge the sufficiency of evidence, identify overlapping charges, and make representations to the prosecution about whether all charges should proceed. This process is a normal part of the criminal justice system and can result in charges being withdrawn or amended if the case law and evidence support it.

Road traffic charges must normally be brought within six months of the offence, though there are exceptions. If you have received notice of charges, you should seek legal advice promptly.
